Not all telecom agreements go smoothly and LB3 is a leader in the representation of large users and non-incumbent carriers in the renegotiation, work-out or, if necessary, litigation of disputes arising out of service problems, failures to meet commitments, overcharges, and market changes. The firm has played a key role in mediations, arbitrations, state and federal litigation, and complaint proceedings before the Federal Communications Commission.

Lawyers from the firm frequently team with litigators or serve as counsel to provide specialized advice in disputes that include telecommunications issues, represent customers dealing with carriers in distress, and testify as expert witnesses in telecommunications and related disputes. And LB3 has taken the lead in the emerging field of telecom tax litigation — it has been lead counsel in 2/3 of the litigated cases (all taxpayer victories) brought to secure refunds of federal excise taxes on long distance service.
